By virtue of Decision 98/317/EC, Sweden is a Member State with a derogation within the meaning of Article 139(1) TFEU. In accordance with Article 4 of the 2003 Act of Accession, Czechia, Hungary and Poland are Member States with a derogation within the meaning of Article 139(1) TFEU. In accordance with Article 5 of the 2005 Act of Accession, Bulgaria and Romania are Member States with a derogation within the meaning of Article 139(1) TFEU.
