As clarified by the case law of the Court of Justice of the European Union, Member States are not permitted to restrict legal standing to challenge a decision of a public authority to those members of the public concerned who participated in the decision-making procedure which led to the adoption of that decision. In addition, any review procedure should be fair, equitable, timely and not prohibitively expensive, and provide for adequate remedies, including injunctive relief as appropriate. Furthermore, in line with the case law of the Court of Justice of the European Union, access to justice is as a minimum to be granted to the public concerned.
