Article 2

1. Member States shall adopt and publish, by 1 January 2028, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions. They shall apply those provisions from 2 January 2029. However, they shall apply the provisions transposing Article 1, points (12) and (13), insofar as they relate to Article 14 and Article 14a(1), (2) and (3), from 2 January 2028. When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. The method of making such a reference shall be laid down by Member States. 2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive. Member States shall notify the Commission by 1 January 2028 of the means by which special negotiating bodies, European Works Councils and employees’ representatives can, pursuant to Article 11(2) to (5) of Directive 2009/38/EC, as amended, bring judicial proceedings and, where relevant, administrative proceedings, in respect of all the rights under that Directive.
