Experience with Directive 2009/48/EC has shown that new toys available on the market, which were compliant with the applicable particular safety requirements when placed on the market, have in specific cases posed a risk to children and therefore do not comply with the general safety requirement. Therefore, this Regulation should ensure that market surveillance authorities can take action against any toy presenting a risk to children, even where it is compliant with the particular safety requirements.
