Recital (102)

The request or obligation to prioritise the production or supply of certain products does not disproportionately affect the freedom to conduct a business and the freedom of contract, which are protected by Article 16 of the Charter of Fundamental Rights of the European Union (the Charter), and the right to property laid down in Article 17 thereof. In accordance with Article 52(1) of the Charter, any limitation on the exercise of those rights and freedoms must be provided for by law and respect the essence of those rights and freedoms, and be subject to the principle of proportionality.
