In cases of severe and persistent shortages of, or an exceptionally high demand for, crisis-relevant products carrying an imminent risk of or materialising in a severe negative impact on the proper functioning of the internal market, prioritisation measures at Union level that aim to ensure the availability of crisis-relevant products could prove to be indispensable in ensuring the proper functioning of the internal market for defence products and its supply chains. The Commission should be able to use in this respect, upon a request of a Member State, priority-rated requests for facilitating the supply of both crisis-relevant defence products and crisis-relevant products which are not defence products, and priority-rated orders for ensuring the supply of crisis-relevant products which are not defence products. Those prioritisation measures should be activated by the Council.
