Recital (23)

A Union compulsory licence should be granted only in the context of a Union crisis or emergency mode. In such a context, the discussions within the advisory body set up under the relevant Union crisis or emergency mechanism could reveal that the lack of adequate supply of crisis-relevant products results from intellectual property rights or the exercise thereof. In such cases, the Commission should have the possibility to initiate the procedure for granting a Union compulsory licence. For reasons of expediency, the Commission should initiate the procedure by publishing a notice on its website. It should also publish that notice in the Official Journal of the European Union without undue delay.
