This Regulation provides for a tool of last resort that is to be used only in exceptional circumstances. The application of this Regulation should be evaluated by the Commission. However, such an evaluation should be carried out only if one or more Union compulsory licences have been granted by the Commission. The Commission should submit its evaluation report to the European Parliament, the Council and the European Economic and Social Committee by the last day of the third year following the granting of the first Union compulsory licence, to allow for an adequate and substantiated analysis.
