To ensure optimal efficiency of the Union compulsory licence as a tool for addressing crises or emergencies, it should be available in respect of a patent or utility model or a supplementary protection certificate. It should also be available in respect of a published patent application or a published application for a utility model. The Union compulsory licence should apply to the same extent to national patents, European patents and European patents with unitary effect.
