Annex 1 — Declarations of the European Union

1. Declaration of the European Union on the Scope of Application with regard to private actors pursuant to Article 3 paragraph 1 subparagraph b of the Convention Recalling the obligation under Article 3 paragraph 1 subparagraph b of the Convention to address risks and impacts arising from activities within the lifecycle of artificial intelligence systems by private actors to the extent not covered in subparagraph a of that provision in a manner conforming with the object and purpose of the Convention, the Union declares that it will apply the principles and obligations set forth in Chapters II to VI of the Convention to activities of private actors placing on the market, making available and using artificial intelligence systems in the European Union through the implementation of Regulation (EU) 2024/1689 of the European Parliament and the Council of 13 June 2024 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (Artificial Intelligence Act). Other relevant Union acquis may also apply to these activities and contribute to the implementation of the principles and the obligations of the Convention. 2. Declaration of the European Union on the Territorial Scope of Application pursuant to Article 32 paragraph 1 of the Convention Pursuant to Article 32 paragraph 1 of the Convention, the Union declares that, with regard to the competence of the Union, the Framework Convention on Artificial Intelligence and Human Rights, Democracy and the Rule of Law is to apply to the territories in which the EU Treaties are applied pursuant to Article 52 of the Treaty on European Union and under the conditions laid down in, inter alia, Article 355 of the Treaty on the Functioning of the European Union.
