Article 18 — Access by insolvency practitioners to beneficial ownership information

Member States shall ensure that, for the purpose of identifying and tracing assets relevant for the insolvency proceedings for which they are appointed, insolvency practitioners have timely access to the following information on the beneficial owners of legal entities and of legal arrangements held in interconnected central beneficial ownership registers, and that such access is provided without alerting the entity, the arrangement or the beneficial owner concerned: (a) the name of the beneficial owner; (b) the month and year of birth of the beneficial owner; (c) the country of residence and nationality or nationalities of the beneficial owner; (d) for beneficial owners of legal entities, the nature and extent of the beneficial interest held; (e) for beneficial owners of express trusts or similar legal arrangements, the nature of their beneficial ownership.
