Member States shall set the criteria for selecting the best bid in the pre-pack proceedings. Member States shall ensure that those criteria are the same as the criteria for selecting among competing bids in insolvency proceedings.
Member States may include the preservation of employment in the criteria referred to in the first paragraph.
