Article 6 — General prerequisites for avoidance actions

Member States shall ensure that legal acts which have been perfected prior to the opening of insolvency proceedings to the detriment of the general body of creditors are void, voidable or unenforceable under the conditions laid down in Chapter 2. Member States may provide that a legal act, the effects of which are conditional upon its entry in a public register, is considered to have been perfected as soon as all the other requirements for its effectiveness have been met.
