To ensure legal certainty, where a Member State allows for the deduction of a depositor’s liabilities to the credit institution when calculating the repayable amount, it is necessary to clarify that only liabilities that have fallen due before the deposits became unavailable may be deducted from the depositor’s eligible deposits, and only to the extent that such set-off is permissible under the applicable statutory and contractual provisions.
