The empowerment in Article 8(1) of Directive 2006/118/EC, which provides for the use of the regulatory procedure with scrutiny, fulfils the criteria in Article 290(1) TFEU, since it concerns adaptations of Parts A and C of Annex II and Annexes III and IV to that Directive. It should therefore be converted to an empowerment for the Commission to adopt delegated acts.
