Where a failing institution or entity is not placed under resolution, it should be wound up in accordance with the procedures available under national law. Such procedures might vary substantially from one Member State to the other. While it is appropriate to allow for sufficient flexibility to use the existing national procedures, certain aspects should be clarified to ensure that the institutions or entities concerned exit the market.
