Article 35 — Replacement of Framework Decision 2003/568/JHA and of the Convention on the fight against corruption involving officials of the European Communities or officials of Member States of the European Union

1. Framework Decision 2003/568/JHA is replaced with regard to the Member States bound by this Directive, without prejudice to the obligations of those Member States with regard to the date for transposition of that Framework Decision into national law. With regard to the Member States bound by this Directive, references to Framework Decision 2003/568/JHA shall be construed as references to this Directive. In particular, references to Article 2 of Framework Decision 2003/568/JHA shall be construed as references to Chapter II of this Directive. 2. The Convention on the fight against corruption involving officials of the European Communities or officials of Member States of the European Union is replaced with regard to the Member States bound by this Directive. With regard to the Member States bound by this Directive, references to that Convention shall be construed as references to this Directive. In particular, references to Article 3 of that Convention on the fight against corruption involving officials of the European Communities or officials of Member States of the European Union shall be construed as references to Chapter II of this Directive.
