Moreover, it is necessary to clarify that the Union financial assistance for innovation referred to in Article 58(1), first subparagraph, point (e), of Regulation (EU) 2021/2115 should not be granted to enterprises in difficulty within the meaning of Commission Communication Guidelines on State aid for rescuing and restructuring non-financial undertakings in difficulty as is the case for Union financial assistance for investments referred to in Article 58(1), first subparagraph, point (b), of that Regulation.
