Enforcement authorities should have the power to provide one another with and use in evidence, in accordance with their national law, any matter of fact or of law, including confidential information. Information provided should only be used in evidence for the purpose of applying this Regulation to enforce the rules established by Directive (EU) 2019/633 and in respect of the subject-matter for which it was collected by the requested enforcement authority. The confidentiality of the information provided should be guaranteed with due regard to the legitimate interests of a natural or legal person concerned. Requests by complainants for protection of information on the basis of Article 5(3) of Directive (EU) 2019/633 should be taken into account and protection should also be ensured in cross-border enforcement.
