Article 59 — Registration

1. If the requirements for an application for a registered EU design have been fulfilled, and to the extent that the application has not been refused pursuant to Article 56, the Office shall enter the design contained in the application and the particulars referred to in Article 104(2) in the Register. 2. If the application contains a request for deferment of publication pursuant to Article 62, an indication of that request and the date of expiry of the period of deferment shall also be entered in the Register. 3. The registration shall bear the date of filing of the application referred to in Article 46. 4. The fees payable pursuant to Article 42(4) and Article 44(2) shall not be refunded even if the design applied for is not registered.
