Pursuant to Article 193 TFEU, protective measures adopted pursuant to Article 192 TFEU do not prevent any Member State from maintaining or introducing more stringent protective measures, under the conditions established by Treaties and the case law. For example, a Member State would be able to maintain an extended producer responsibility scheme for waste textiles on microenterprises which is already in force at the time of entry into force of this amending Directive.
