Taking into account the minimum harmonisation nature of Directive 2013/11/EU, Member States have the right to apply ADR procedures to disputes relating to other rights provided for in Union and national law, such as rights arising from Articles 101 and 102 of the Treaty on the Functioning of the European Union. Furthermore, it is for the Member States to determine which ADR entity is competent for which type of dispute.
