Recital (51)

The impact of this Regulation on the procedural autonomy of the Member States should be limited to what is necessary to ensure the objective of protecting human health through a safe environment pursued by it and should not affect other national procedural rules establishing the right to seek compensation for infringements of this Regulation. Such national rules should, however, not hamper the effective functioning of the mechanism for seeking compensation required by this Regulation.
