Article 36 — Capacity allocation through the ad hoc process

1. The infrastructure manager shall respond without undue delay, and in any event within the deadlines set out in Section 7 of Annex I, to ad hoc requests for railway infrastructure capacity submitted at any time during the validity of the working timetable. Information on available spare capacity shall be made available in accordance with Article 10 to all applicants who may wish to use this capacity. Capacity rights granted through the ad hoc process shall take the form of train paths. 2. The allocation of railway infrastructure capacity in response to ad hoc requests shall be based on the first come, first served principle.
