Recital (7)

The EU Talent Pool aims to provide information to jobseekers from third countries and to participating employers and other participating entities that are lawfully established in the participating Member States. For the purposes of this Regulation, an employer or other entity is to be considered to be lawfully established in a Member State where it pursues a genuine substantial economic activity in compliance with the national laws and administrative requirements of that Member State. The concept of other participating entity should refer to a temporary work agency, a private employment agency or a labour market intermediary. The term temporary work agency is to be understood as the term defined in Article 3(1), point (b), of Directive 2008/104/EC of the European Parliament and of the Council. The term private employment agency is to be understood as the term defined in the Private Employment Agencies Convention, 1997 (No. 181) of the International Labour Organization (ILO).
